Privacy Policy, Gangify

Gangify is a Shopify app that lets a merchant's customers design DTF gang sheets and order them. This Privacy Policy describes what personal information Gangify collects, how it is used, who it is disclosed to, and the rights available to the people it belongs to.

Please read it carefully. By installing Gangify, or by using a gang sheet builder powered by Gangify on a merchant's storefront, you acknowledge the collection, use and disclosure of information described here.

Who we are

Gangify is made and operated by Out of Ink Prints, a company registered in the United States.

Out of Ink Prints also operates a retail store at outofinkprints.com. That store has its own separate privacy policy, and this policy does not cover it. This policy covers the Gangify app only.

Who this policy covers

Two groups of people are involved, and they are treated differently under data protection law:

Merchants, the Shopify store owners who install Gangify.
Shoppers, the customers who use a gang sheet builder on a merchant's storefront.

For shopper information, the merchant is the data controller and Gangify is a data processor. The merchant decides what happens to their shoppers' information, and Gangify handles it only to provide the service that merchant asked for. For merchant information, such as the settings a merchant configures and the messages they send us, Out of Ink Prints is the controller.

This distinction matters for the rights described later: a shopper exercises their rights through the merchant they ordered from, not through us directly.

Personal information we collect or process

When we say personal information we mean information that identifies, or can reasonably be linked to, a particular person. It does not include information collected anonymously or de-identified so that it cannot reasonably be linked to anyone.

From shoppers who use the gang sheet builder

Artwork and designs. The images a shopper uploads, and the layout describing where each one sits on the sheet. Both are needed to produce the print file the merchant prints.
The Shopify customer ID, and nothing more about the person. Gangify does not store shopper names, email addresses, phone numbers, shipping addresses or payment details.
A random identifier for shoppers who are not signed in, stored in that shopper's own browser so they can return to a sheet they have not finished. It is not linked to any person and cannot be used to identify them.
Free-text notes. A shopper may add a note to an order. Whatever they type is stored and shown to the merchant, so shoppers should not put sensitive personal information in it.

Shopper names shown in a merchant's print queue are read from Shopify each time that page loads and are never written to Gangify's database.

From merchants who install Gangify

Store domain, the access token Shopify issues at install, and the settings configured in the app.
Support messages. If a merchant uses Contact the developer in the app, the message they write, the reply address they give, and their store domain, plan and API version are emailed to us. The message itself is not stored by Gangify. The app records only that the store sent a message and when, so it can limit how often the form is used, and that record is deleted with the rest of the store's data on uninstall.
The form tells merchants, on the page, not to include customer details, and the app attaches no order or customer information to it.
Email preferences. If a merchant chooses, under Email from Gangify, to receive product updates or notices about their store's setup, we keep the email address they confirm, which options they chose, the wording they agreed to and when. Nothing is collected unless the merchant turns an option on, and every email includes a link to stop them.
Notices dismissed in the app. When a merchant dismisses a notice on the app's home page, we record that so it is not shown again.

Order records

The Shopify order ID, the line item ID, the price charged, the sheet dimensions, and the result of the internal price check.

What we do not collect

Some categories that appear in most privacy policies genuinely do not apply to Gangify, and it is more useful to say so plainly than to leave them unmentioned:

No payment or financial information. Payment is handled entirely by Shopify and its payment providers. Card numbers and financial account details never reach Gangify.
No contact details for shoppers. No names, email addresses, phone numbers or postal addresses.
No IP addresses, browser fingerprints or user agent strings are read or stored by the app.
No advertising or analytics cookies, and no tracking of shoppers across other websites.

Cloudflare and Shopify necessarily process connection information, including IP addresses, in order to deliver the service, in the same way any website host does. Their own privacy terms govern that processing.

Where the information comes from

Directly from the person, when a shopper uploads artwork and lays out a sheet, or when a merchant configures the app or contacts us.
From Shopify, which supplies the order and customer identifiers the app needs to attach a design to an order.
Generated by the app itself, such as the result of the internal price check on an order.

How we use personal information

We also use this information to comply with applicable law, to respond to valid legal process, and to enforce or investigate potential violations of our terms.

What Gangify does not do

No advertising, no ad networks, no analytics, and no tracking of shoppers across sites.
Personal information is never sold, rented, or shared for anyone else's marketing.
No profiling, and no automated decisions producing legal or similarly significant effects.
No marketing email is sent to shoppers. Gangify sends no email to shoppers at all.

How we disclose personal information

Gangify runs entirely on infrastructure provided by two sub-processors:

Cloudflare, Inc., application hosting, database and file storage.
Shopify Inc., the platform the app runs on and the source of order and customer data.

No other third party receives shopper or merchant data in the ordinary course of operating the app. Beyond those sub-processors, we may disclose personal information:

When the law requires it, including in response to subpoenas, search warrants, and similar valid legal process.
To protect rights and safety, including to investigate suspected fraud, abuse or misuse of the app, and to enforce our terms.
In connection with a business transaction, such as a merger, acquisition or insolvency, in which case the recipient remains bound by this policy until it is superseded.

Our relationship with Shopify

Gangify is distributed through the Shopify App Store and operates inside a merchant's Shopify store. Shopify collects and processes information about access to and use of a merchant's storefront independently of us, under its own terms. How long we keep information

Unfinished designs by a shopper who is not signed in: deleted automatically after a period the merchant sets, seven days by default.
Sheets saved to a customer account: kept until the shopper deletes them, because being able to return to one is the point of saving it. They are removed if the account is deleted, or when the merchant uninstalls the app.
Sheets added to a cart but never ordered: deleted automatically after fourteen days.
Designs attached to an order: kept while the merchant may still need them to print or reprint, up to the retention period set in the app, twenty four months by default.
Order records: kept as long as the app is installed, as a record of what was sold.
Merchant email preferences: kept until the merchant changes them or uninstalls the app. They are deleted immediately on uninstall, so no email is sent to a store that has removed Gangify.
On uninstall: the merchant's access token and session are deleted immediately, and the shop's stored data is removed on the shop redaction schedule described below.

Shoppers can delete their own saved sheets at any time from the builder. A sheet attached to an order is removed from the shopper's list, while the merchant keeps the copy they need in order to fulfil the order they were paid for.

Where information is stored, and international transfers

Information is stored on Cloudflare's global network and may be processed in any region Cloudflare operates in, including outside the country where the person lives.

Where personal information is transferred out of the European Economic Area or the United Kingdom, we rely on the transfer mechanisms in our sub-processors' data processing agreements, including the European Commission's Standard Contractual Clauses and the United Kingdom equivalent, or on transfers to a country recognised as providing an adequate level of protection.

Security

All traffic is encrypted in transit using HTTPS.
Requests from a merchant's storefront are cryptographically verified before any data is returned, so one store can never read another's.
Links to artwork are individually signed and expire after one hour.
Uploaded files are verified by inspecting their actual contents rather than their filename, and document formats that can carry executable content are not accepted.

No security measures are perfect or impenetrable, and this policy does not promise otherwise. Any information sent to us may not be secure while in transit, so please do not use unsecured channels to send us sensitive or confidential information.

Your rights and choices

Depending on where you live, you may have some or all of the rights below. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request as permitted by law. We will not discriminate against anyone for exercising them.

Access, or the right to know, what personal information is held about you.
Deletion of personal information held about you.
Correction of inaccurate personal information.
Portability, a copy of your personal information and, in certain circumstances, its transfer to a third party.
Objection or restriction of certain processing, where applicable law provides it.

Gangify does not sell or share personal information, and does not process it for targeted advertising, so there is nothing to opt out of in that respect.

If you are a shopper

Contact the merchant you ordered from. They are the controller of your information, and Shopify routes their request to us automatically. Gangify honours Shopify's mandatory privacy webhooks:

Data request, a copy of what Gangify holds for that customer.
Customer redaction, deletion of that customer's designs and artwork.
Shop redaction, deletion of everything held for a store, forty eight hours after uninstall.

If you are a merchant

Contact us using the details at the end of this policy. We may need to verify your identity before acting on a request, as permitted or required by applicable law. You may designate an authorised agent to make a request on your behalf, in which case we will require proof that you authorised them, and may still need to verify your identity with you directly. We respond within the time applicable law requires.

Children's data

Gangify is not intended for use by children, and we do not knowingly collect personal information from children under the age of majority in their jurisdiction. As of the date of this policy, we do not have actual knowledge that we sell or share, as those terms are defined in applicable law, the personal information of anyone under sixteen years of age.

If you are the parent or guardian of a child who has provided personal information through a merchant's gang sheet builder, contact that merchant, or contact us using the details below, and we will arrange for it to be deleted.

Complaints

If you have a complaint about how personal information is handled, please contact us using the details below. Depending on where you live, you may have the right to appeal our decision, or to lodge a complaint with your local data protection authority.

Changes to this policy

We may update this policy from time to time, to reflect changes in our practices or for other operational, legal or regulatory reasons. The revised policy will be posted at this address, the Last updated date will be changed, and merchants will be notified in the app before a material change takes effect.

If your question is about a specific order, include your store domain and the order number. If you are a shopper, contact the merchant you ordered from first, as they hold your order details and we may not be able to identify you without them.
